DMCA & Takedown Policy

Archade respects copyright and responds to valid takedown notices. This policy explains the procedure.
We comply with the Digital Millennium Copyright Act (DMCA) and equivalent frameworks. Images and other media are central to our platform; we take copyright seriously and process notices in good faith.
1. Submitting a Takedown Notice
If you believe content on Archade infringes your copyright, send a written notice to our designated agent:

Your notice should include:
- Identification of the copyrighted work you claim is infringed (e.g., description or registration details).
- Identification of the infringing material (e.g., URL(s) of the specific page(s) or asset(s)).
- Your contact information (name, address, email, phone).
- A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
Incomplete or unclear notices may be rejected or delayed. We may request additional information to process your claim.
2. Response Timeline
- We aim to acknowledge valid notices promptly (e.g., within a few business days).
- We will review and, where appropriate, remove or disable access to the allegedly infringing content in line with the DMCA and our policies.
- We will notify the user who posted the content (where we have contact details) and may provide a copy of the notice, as permitted by law.
- Typical action: Removal or disabling within a short period after we determine the notice is valid and complete. Exact timing can depend on volume and complexity.
3. Counter-Notice
If your content was removed and you believe the removal was mistaken (e.g., you have rights or the use is fair), you may submit a counter-notice to copyright@archade.app containing:
- Identification of the material that was removed and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed due to mistake or misidentification.
- Your name, address, email, and phone.
- Consent to the jurisdiction of the federal court for your district (or, if outside the US, any judicial district in which Archade may be found).
- Your physical or electronic signature.
If the original claimant does not file a court action against you within the applicable period (e.g., 10–14 business days), we may restore the content.
4. Repeat Infringer Policy
We maintain a repeat infringer policy:
- We track valid takedown notices and counter-notices.
- Users who receive multiple valid copyright strikes may have content removed and accounts suspended or terminated.
- We reserve the right to terminate accounts of users who are repeat infringers, in line with the DMCA and our Terms of Service.
5. Misrepresentation
The DMCA provides for liability for misrepresentation in a takedown or counter-notice. Do not submit a notice or counter-notice that you know to be false. We may reject abusive or bad-faith notices and, where appropriate, refer the matter or share information with relevant parties.
